This Privacy Policy (“Policy”) describes the privacy practices of Fletcher IP (“we,” “our,” or “us”), including our website at protectyour.work (“Site”). The Policy explains how personal information about you may be collected, used, and disclosed. It also explains the rights and choices you may have regarding your personal information.

Fletcher IP is a U.S.-based intellectual property law practice. Our contact details are listed in Section 10 below.

1. Information We Collect

We collect personal information (“Personal Information”) and other information from a variety of sources and in a variety of ways, including those listed below. Personal Information means information relating to an identified or identifiable natural person. To the extent permitted by applicable law, Personal Information does not include information that has been deidentified, pseudonymized, or anonymized.

Legal Services and Business Administration. We collect Personal Information in connection with providing legal services and administering our practice. This includes information about individuals associated with our clients, prospective clients, and their affiliates — such as employees, representatives, and other contacts — as well as information about other individuals who arise in the course of legal matters, such as adverse parties, inventors, and witnesses. The type of information collected is necessarily broad and varies depending on the nature of the legal matter, and includes name, email address, postal address, telephone number, and unique identifiers.

Interactions with the Site and Us. When you visit the Site, you may choose to provide Personal Information such as your name, email address, telephone number, and company name. You may do so by sending us an email, submitting a contact or intake form, purchasing a service through our Stripe payment links, or otherwise communicating with us.

Purchase and Transaction Information. We collect information necessary to process payments for our legal services, including payment data processed through third-party payment processors such as Stripe. We do not store full payment card numbers on our servers.

Job and Contractor Inquiries. If you contact us about working together, we collect information you provide, including your name, contact details, and professional background.

Device and Browser Information. When you visit the Site, we may collect technical information such as your browser type, operating system, internet service provider, pages visited, time spent on pages, and the IP address assigned to your device. This information is collected automatically through cookies and similar technologies.

Information from Third Parties. We may receive Personal Information about you from third parties, including freelancing platforms through which you contact us, social media platforms if you interact with us there, and other business partners.

You are not obligated to provide Personal Information in all cases described above. However, without certain information, we may not be able to provide legal services, respond to your inquiry, or process a transaction.

2. How We Use Personal Information

We use the Personal Information we collect for the following purposes:

  • To provide legal and related services, including representing clients, responding to requests for services, performing conflict checks, and processing payments.

We do not sell your Personal Information.

  • Persons involved in your legal matter, such as opposing counsel, co-counsel, courts, government bodies, and experts, in the course of representation.
  • Service providers who assist us in operating our practice, such as payment processors, cloud storage providers, document management platforms, and IT service providers. These providers are authorized to use your information only as necessary to provide services to us.
  • Business and marketing partners, where appropriate and consistent with your preferences.
  • Successor entities in connection with a merger, acquisition, reorganization, or sale of assets, or in preparation for any such event.
  • Law enforcement, courts, or other parties where we believe disclosure is required to comply with applicable law, a court order, or legal process; to protect the safety or security of any person or the Site; or to enforce our terms of service.
  • Other parties with your consent.

4. Cookies and Similar Technologies

When you visit the Site, we or authorized third parties may place cookies on your device. Cookies are small data files that help the Site function, recognize returning visitors, and analyze usage patterns. We may also use web beacons and similar tracking technologies.

You may configure your browser to reject or delete cookies. Doing so may limit certain functionalities of the Site. The Site does not currently respond to “Do Not Track” signals.

5. Your Rights and Choices

Opt Out of Marketing. If you wish to stop receiving marketing communications from us, please contact us using the information in Section 10 or use the unsubscribe link included in any marketing email. Even if you opt out, we may continue to communicate with you for non-marketing purposes, such as matters related to your legal services.

Unsubscribe from Emails. Each marketing email we send includes an automated opt-out (unsubscribe) mechanism. Follow the instructions in the email to unsubscribe.

Notice to California Residents. If you are a California resident and the California Consumer Privacy Act (“CCPA”) applies to our processing of your Personal Information as a business under the CCPA, the following applies. This section does not apply to Personal Information we collect in the context of an employment or purely business-to-business relationship to the extent exempted under applicable law.

We collect the following categories of Personal Information and may have collected any or all of them in the preceding 12 months: (a) identifiers such as name, postal address, email address, and account name; (b) categories of personal information described in Cal. Civ. Code Section 1798.80(e), such as telephone number and financial information; (c) commercial information, including records of services purchased or considered; (d) internet or other electronic network activity information, including browsing history and interaction with the Site; (e) geolocation data; and (f) professional or employment-related information.

We collect this information from the sources listed in Section 1 and use it for the purposes listed in Section 2. We do not sell Personal Information to third parties.

You have the right to: (a) request disclosure of the categories and specific pieces of Personal Information we have collected about you in the preceding 12 months; (b) request deletion of your Personal Information; and (c) not receive discriminatory treatment for exercising your CCPA rights.

To submit a CCPA request, please contact us using the information in Section 10. We will take reasonable steps to verify your identity before responding. We may deny or limit responses where we cannot verify your identity or where we suspect fraudulent activity.

6. Data Retention

We retain your information for as long as necessary to provide the services you have requested, to comply with our legal and professional obligations (including attorney recordkeeping requirements and applicable statutes of limitations), to resolve disputes, and for other legitimate business purposes. Specific retention periods vary based on the nature of the information and the purpose for which it was collected.

7. Security

We employ technical and organizational measures that we believe are reasonably appropriate to protect your Personal Information. However, no security system is impenetrable, and we cannot guarantee that your information will never be accessed, disclosed, altered, or destroyed. Transmission of information over the internet is inherently not fully secure.

8. Third-Party Websites and Links

The Site may contain links to third-party websites, including social media platforms and payment processors. We are not responsible for the privacy practices of those sites. We encourage you to review the privacy policies of any third-party sites you visit. Those sites may independently associate your visit with your personal information.

9. Changes to This Policy

We reserve the right to modify this Policy at any time. We will post the updated Policy on the Site with a revised effective date. For material changes, we will provide additional notice, such as a prominent notice on the Site or direct communication to you. Your continued use of the Site or our services after the effective date of any changes constitutes your acceptance of the revised Policy.
